Thanks for the response- just saw the comment you made about my statement "figuring it all out". 

Is the list of Tribes in Florida up to date?  I don't mind driving an hour and a half to Winter garden, was just curious if any other groups had popped up.

Also, do you plan on doing any seminars or trainings in the next year or so?

Dear Mr. Seykota,
This law firm represents 3M Company (“3M”) in trademark and unfair competition matters. We write regarding your use of the famous mark POST-IT and images of canary yellow sticky notes in connection with an inappropriate image displayed on your website at

3M is the owner of the mark POST-IT, among the most famous marks in the world. See Minn. Min. & Mfg. Co. v. Taylor, 21 F. Supp. 2d 1003, 1005 (D. Minn. 1998) (finding POST-IT mark famous); 3M Co. v. Professional Gallery, Inc., No. 91173411, slip op. at 11 (TTAB Jul. 17, 2014) (“The above evidence leaves us in no doubt that POST-IT is a famous mark for sticky notes.”); 3M Co. v. Christos Leridis, Opposition No. B 002276247, slip op. at 6 (OHIM Jun. 30, 2015) (POST-IT marks “have acquired a high degree of distinctiveness through their use on the market.”). 

3M has used its famous POST-IT mark continuously for more than three decades in connection with its revolutionary repositionable adhesive notes, as well as a variety of other highly successful consumer and office products. 3M promotes the POST-IT brand and products on its website 
(e.g. and,
as well as various social network sites such as Facebook and Twitter. 

In addition to its extensive common law rights, 3M owns numerous U.S. trademark registrations, many of which are incontestable, for the famous POST-IT mark, including in the logo form shown below featuring a fan of yellow notes. See, e.g.,  U.S. Reg. Nos. 1046353, 1198694, 1208297, 1284295, 1935381, 2371084, 2736421, 3168105, 3176638,  and 3861083.

3M also owns U.S. Reg. No. 2390667 for its famous canary yellow color.
The public strongly identifies the POST-IT mark and logo with 3M and its goods and services. Consequently, 3M enjoys valuable goodwill, as well as strong and enforceable rights, in that mark. Because this goodwill is important to 3M, it cannot permit others to use its POST-IT mark (or any confusingly similar mark) in a way that is likely to dilute the strength of 3M’s famous POST-IT mark.

It has come to our attention that you are operating the website at, which displays an inappropriate image comprised of the POST-IT mark and canary yellow sticky notes superimposed over a photo of a nude woman  (image below). The image is located at:
Your use of the famous POST-IT mark and logo in this manner is likely to confuse consumers as to some relationship with the POST-IT brand and products, and is also likely to cause dilution of 3M’s famous POST-IT mark by tarnishment. Thus, your use violates 3M’s trademark rights. See, e.g., 15 U.S.C. §§ 1114(1), 1125(a), and 1125(c).
Accordingly, we demand that you immediately remove this image from your website and agree that in the future you will not use the POST-IT mark or any confusingly similar marks or logos in connection with your website. 
We ask you to respond as soon as possible, and no later than ten days after your receipt of this letter, giving your assurance that you will promptly comply with the above demands.  You may indicate your agreement by signing this letter in the space below and returning it to us.

You might like to know that within 15 minutes of receiving your communication, I complete the removal of the item from FAQ - per my custom for immediately dealing with items people want to remove, for any reason or without a reason.

I notice your letter about this matter arrives in May of 2016, some 6+ years after the item appears on my site.  I wonder if this might qualify for a world record!

I also notice your client's patent currently in expiration.

You can now get a similar stick-on product, in a slightly different color, from other suppliers, such as from Quill:

You can purchase the 3M product for $13.99 and the Quill product for $8.99.

As you point out, goodwill might account for some of your client's competitive advantage.

I wonder if you feel your tone in dealing with people has any effect on this goodwill - particularly in framing your request as a legal demand, without first attempting to secure cooperation through establishing rapport.

You might consider taking your feelings about <demanding rather than asking> to Tribe as an entry point.

Tribe Report

Dear Chief,

Our virtual Tribe meets to present our projects. We check-in and share our feelings, as they come up.  We do a second check-in on the feelings and events since our last meeting.

I notice there is a common thread: All Tribe members report feelings of ownership and taking proactive steps to guide their behaviors to get results they want.

I feel excitement and energy as we meet.

We move on to present our projects. I share my project and receive very valuable feedback. Most of the feedback I receive has to do with a lack of clarity in my communication and presentation. My plan and process are unclear to the Tribe.

I recognize that I take shortcuts when communicating with others by using placeholder words and concepts to represent ideas that I don't feel like explaining clearly.

I continue to think about the feedback into the night after the meeting until I fall asleep.
When I wake up, I feel tired and contemplate the very vivid dreams I have last night.


I dream about:

Patronage: An employee comes to me for help about his child, I feel warm and care for him. I value him and like helping.

Power struggle:  A former partner observes the interaction with the employee and he is angry about my having a position of authority and responsibility. He says he is sick of people turning to me for support. I think he feels overlooked and impotent. He attempts to convince the employee that I am no good.  I feel violated and betrayed and sad. My face feels heavy.

Dependency: I feel like I need this employee, I worry if he'll stay with me.

Fairness: I wonder if I have done enough to compensate and support this employee. I conclude that I have and feel a solid feeling of connection and trust with him.

Fist Fight: The attack from the former partner continues and becomes physical. He jumps up from his chair to punch me.  I restrain him after he attacks me. I am unharmed. I feel bad about the conflict and sad that he does not like me. I end up protecting myself and enforcing my boundary. I feel calm and safe while this happens.


This morning I continue to feel heavy headed with a mild headache at the base of my skull.

The dreams and feelings of conflict, anger and fear leave me feeling like I've tapped into a potential entry point for Rocks Process. I think the feelings and dreams are able to surface as a result of the meeting. I like having access to this new information.

Our Virtual Tribe continues to feel like Tribe and I'm noticing the friction of the format (such as physical distance and technical issues) less and less with each meeting.

While our meeting is session I frequently forget we are not in the same room.

I feel pleased with our progress and really enjoy the connection and rapport we have.

I change the words in my virtual lab project from passive and noncommittal to present tense and proactive. I notice a sense of ownership radiating from the work to other aspects of my life.

A Trader or Nothing

The biblical story of Joseph is about a young shepherd boy who has a gift for interpreting dreams. 

He also has a gift for dramatic swings in his “equity”.  He goes from favored son, to slave, to running a major aristocratic household, to jail, to viceroy of Egypt.  He advises Pharaoh to buy grain cheap during the time of plenty, store it, and sell dear during the famine foretold in Pharaoh’s Dream. 

This Savvy trading results in his promotion to Viceroy of the most powerful nation of the time, ending his equity drawdowns.

My story reflects Joseph’s ups and downs.  From 1993-2015 I experience wild swings in my equity.  I am a good trader and able to make money, however I have trouble holding onto it.  In 2015 I embark on a journey which includes work with my Trading Tribe.  This journey includes self-discovery and a commitment to intimacy. 

My trading becomes less exciting, less dramatic.  My earnings become more stable.  My life and relationships also start to exhibit less drama. 
Feeder Cattle, Live Cattle and Lean Hogs are the contracts I trade most actively.   At the beginning of 2016 these contracts become subject to rules about the volume of messaging (changing order
specifications).  As a spread trader/market maker working to earn the bid/over spread this change
interferes with the execution of my trading strategy.  I change  my entire execution strategy shifting from posting bids and orders to sniper trading (automatically hiding posted bids and orders when they reach my price.

Trading results since the change have been unimpressive.  I experience lower trading volume, lower PnL volatility and lower profits.  The purpose of this project is to face the challenge, and get my trading back on track.

From February 2016 through April 2016 my response is to medicate my feelings.  My techniques for medicating my feelings of fear and anger include compulsive sex, shopping, travel.  Ignoring, and denying the problem and procrastination.  I fear that if I am unable to adapt as a trader I will lose my self-identity
and ability to earn an income.  I fear that if I look hard at this issue I will not be able to withstand the emotional impact.

* I have adapted several times over my career.  I have experience with this
* I know what it takes to right this ship.

I am a trader.
I am a well-paid, professional trader
Starting today I will reintroduce into my life and my trading the practices which support success.

* Mental training (prayer and meditation)

I draft an action plan and schedule incorporating the practices supporting success.  I document the
implantation of the schedule, and report the results.

Dear Ed,

Your reply dated 18th April 2016 Dealing with Ex-Wife makes me introspect again and again.

I get this feel that I get fooled very easily by manipulations. I notice that I love to notice this as now I see myself becoming wise when I pay attention to my feelings.

I remember your statement about taking positive intentions of feelings.  AHA!

Niece calls me to discuss issues being faced by my sister. I instantly notice what is coming (in the non existent future, of course).

I remind her that she also, just like me is being manipulated to continue helping some people while they continue to enjoy life and keep on putting burden on others.

I notice her resistance to accept facts.

Unlike past, I let it go. I make it clear that I am now a wise man. I do not allow others to take my undue advantage.

This all wisdom comes mainly due to my paying attention to my feelings.

So many many hugs to you my dear Ed Seykota.
